Acceptance of Terms

By accessing or using FunChat at funchat.in (and any FunChat-branded site on the same service), including browsing, chatting, playing games, uploading content, creating an account or making a payment, you agree to be bound by these Terms of Service, our Privacy Policy and our Disclaimer. If you do not agree, do not use FunChat.

We may update these terms at any time. For significant changes we will tell you in the app. Continued use of FunChat after changes are posted constitutes acceptance of the updated terms. The "Last updated" date at the top of this page shows the most recent revision.

These terms are an electronic record under the Information Technology Act, 2000 and the rules made under it. They do not need a physical or digital signature.

FunChat Is a Platform (Intermediary)

FunChat is an "intermediary" as defined in Section 2(1)(w) of the Information Technology Act, 2000. We provide a technical platform on which users communicate with each other and play games. Everything users say, send, draw, upload, name themselves or share is created by those users, not by FunChat.

• We do not initiate the transmission of user content, we do not select who receives it, and we do not select or modify it.
• We do not pre-screen or endorse user content, and we are not required to monitor it generally. Automated safety tools that run in the background, and moderation we do in good faith, do not make us the author, editor or publisher of user content, and do not remove the protection the law gives intermediaries.
• Users are not our employees, agents or representatives. We are not a party to any conversation, arrangement or dispute between users, whether it takes place on FunChat or elsewhere.
• We do not verify any user's identity, age, gender, location or intentions. Anyone you meet on FunChat is a stranger.
• Where we receive actual knowledge of unlawful content, through a court order, a notification from an appropriate government agency or a valid complaint, we act as the law requires (see "Moderation and Bans" and our Grievance Officer in the Privacy Policy).

Age Requirement — 18+ Only

We reserve the right to request age verification at any time and to suspend or terminate accounts where we have reason to believe the user may be underage.

Acceptable Use

FunChat is a platform for free, anonymous conversation and games. You are responsible for everything you say, share or do on the platform. Under Rule 3(1)(b) of the IT Rules, 2021, you must not host, display, upload, modify, publish, transmit, store, update or share any information that:

• belongs to another person and to which you have no right;
• is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, defamatory, racially or ethnically objectionable, or otherwise unlawful;
• is harmful to a child in any way;
• infringes any patent, trademark, copyright or other proprietary right;
• violates any law in force;
• deceives or misleads about its origin, or knowingly communicates false or misleading information, or impersonates another person (including staff), including by AI-generated or deepfake material;
• threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or incites an offence, or is insulting to another nation;
• contains software viruses or any code designed to interrupt, destroy or limit the functionality of any computer resource.

In addition, the following are strictly prohibited on FunChat:

• Posting, sharing or requesting child sexual abuse material (CSAM) or any content involving minors in a sexual context
• Harassment, threats, bullying, teasing or targeted abuse of any user
• Hate speech based on race, religion, gender, sexuality, nationality, disability or any other characteristic
• Sharing anyone's private information without consent (doxxing), including their phone number. Sharing phone numbers, links to other sites and social-media names or IDs is blocked, and trying to get around these blocks is itself a violation
• Posting spam, repeated identical messages, unsolicited advertising, scams or pyramid schemes, or flooding chats
• Attempting to hack, disrupt or overload FunChat, or using bots, scripts or automated tools to interact with it
• Sharing synthetic, AI-generated or deepfake images, audio or video that misrepresent a real person or that sexualise any individual, especially a minor. Synthetic content must be labelled as such where you share it
• Cheating or abusing games (for example collusion, exploiting bugs, or harassing other players), and using abusive names, avatars or drawings in Draw & Guess or Ludo
• Attempting to circumvent a ban or rate limit through a new username, device, VPN or IP address
• Selling accounts, VIP status or usernames, or using FunChat for any commercial purpose without our written permission

Some of this conduct, including threats of violence, sexual exploitation of a minor, stalking and criminal intimidation, is also a criminal offence under Indian law (including the Bharatiya Nyaya Sanhita, 2023 and the POCSO Act, 2012) independent of any action FunChat takes. Reported content and related records may be shared with law enforcement where required by law.

If you break these rules, we may remove or block your content, warn you, restrict or end your access, ban your username, device or IP, withhold or cancel VIP without refund, and report you to the authorities. These reminders are repeated periodically in the app.

The following are perfectly fine: chatting anonymously under any username you choose, sharing images and GIFs that follow these rules, skipping or leaving conversations at any time, chatting in any language, and using FunChat on any device.

Content Responsibility

You are solely responsible for all messages, images, GIFs, voice notes, drawings, usernames and any other content you post on FunChat. We do not create user content and we are not responsible for it.

By posting content you confirm that you own it or have the right to share it, that it does not break the law or these terms, and that it does not infringe anyone's rights.

Messages and uploaded media are deleted automatically: global chat messages 15 minutes after they are sent, chat-room messages after 10 minutes, random-chat media within a few hours, Friends voice messages after 24 hours, and other Friends messages after 90 days. FunChat uses automated tools to detect and block content that breaks these terms (see our Privacy Policy).

Deleting your messages. You can delete messages and images you sent in global chat and random chat. Deletion removes them from the chat view; it cannot recall anything another user has already seen, saved or screenshotted, and a message that has already been reported may be kept for moderation review.

Image screening. FunChat blocks NSFW images. Sexually explicit or nude images, and anything involving minors, are not allowed. Our automated screening is strict, so it may also block harmless images, and it can miss prohibited ones. Users who send prohibited content can be banned permanently and reported to the authorities. This screening does not make FunChat responsible for what users send.

Personal information and photos are at your own risk. Do not share personal information or personal or intimate photos with other users. If anything you choose to share is saved, leaked, re-shared or misused by another user or third party, FunChat is not responsible or liable for it. This includes Friends chats, voice messages, photos and calls: anyone you talk to can screenshot, record, copy or forward them, and chats can leak. Never share phone numbers, addresses, ID or bank/UPI details, passwords or OTPs, personal or intimate photos, or social-media IDs.

Meeting people. We strongly advise against meeting anyone you met on FunChat. If you do, you do so at your own risk.

Accounts, Usernames and Sign-in

You can use most of FunChat without an account. Some features need a username, a password or an email address.

• Keep your credentials safe. You are responsible for activity under your username and password. Tell us at once if you think someone else is using your account. Sign-in by emailed one-time code is available where you have added an email.
• Usernames. Usernames must not be offensive, misleading, impersonate others, contain a phone number or contain a banned word. A username you have recently used is reserved for you for 72 hours, and we may change or remove a username that breaks the rules. VIP members can rename their username without losing VIP.
• Deleting your account. You can delete your FunChat account, your Friends account, or both from Settings. You have 72 hours to cancel. After that the deletion happens automatically. Some records must be kept as described in our Privacy Policy, and deleting an account does not entitle you to a refund. Your friends will see your account as "Deleted account", your messages will show as not available, and your voice messages and photos are removed from our servers.
• Our rights. We may suspend or terminate an account that breaks these terms or the law, or that is inactive for a long period.

What FunChat Offers (Chat Modes, Games, Friends, VIP and AI)

FunChat is a set of free, anonymous communication and entertainment features. They are all provided as a platform: what users say, send or draw is their own content (see "FunChat Is a Platform"). Features can change, be limited or be withdrawn.

• Global chat: a public chat room for everyone online, with text, images, GIFs, voice notes, polls, replies, reactions and private messages. Messages and media are deleted 15 minutes after they are sent. There are rate limits and automatic filters.
• Random chat: one-to-one chats with a stranger by text, voice or video. Text chats are not stored. Images and voice notes sent in random chat are deleted within a few hours. Calls are peer-to-peer, are not recorded, and starting a call is a VIP feature with a daily time limit. You can skip, block, report and (if you have an account) add a stranger as a friend.
• Chat rooms and the public voice room: topic and private rooms with their own owners and moderators, room rules, bans and invite links. Room messages are deleted 10 minutes after they are sent. There is a limit of 5 messages per minute in rooms.
• Friends: add people by Friend ID and message them privately. This includes text, replies, reactions, voice messages (the audio is deleted after 24 hours), one-time view photos (screened, and deleted as soon as they are viewed or 33 seconds after they are sent, whichever comes first), voice calls (only VIP members can start a call, up to 150 minutes a day per friend, and anyone can switch calls off in Settings), call history, themes, blocking and reporting. Text messages are deleted after 90 days.
• Games: Draw & Guess and Ludo (random players, private rooms, bots that fill empty seats, in-game chat, points and leaderboards). Free to play, with no real-money stakes or prizes.
• Confessions and community features: anonymous posts and comments, which may be reviewed before they appear.
• AI features: an AI companion you can chat with, and automated AI moderation. AI replies are generated automatically, can be wrong, and are not advice.
• VIP membership: a paid plan with a VIP badge (pill, blue tick or gold tick, which you can also hide), higher limits for photos, voice messages and calls, voice and video calling, ad-free chat and match preferences. See "VIP Membership and Payments".
• Safety tools: block, report, strict word and child-safety filters, phone-number, social-media and link blocking, spam and rate limits, image screening, automatic bans, and a safety notice when someone shares a social-media name. See "Moderation and Bans".
• Accounts and settings: optional username, password and email (sign-in by emailed code), renaming, deleting your account (72 hours to cancel), sounds, backgrounds and themes, and music.

Stay on FunChat. Moving a conversation to another app, or sharing phone numbers or social IDs, can lead to blackmail, scams and other harm. FunChat is not responsible for anything that happens outside FunChat.

Zero Tolerance for CSAM and Minors on the Platform

Any CSAM or child-endangerment content detected or reported is immediately reported to India's National Cyber Crime Reporting Portal (cybercrime.gov.in) and/or the appropriate Special Juvenile Police Unit or local police, and evidence is preserved for law enforcement. Accounts and IP addresses involved are permanently banned. We may additionally notify NCMEC as a supplementary international channel, but Indian reporting is our primary legal obligation as an India-based platform.

Anyone who self-discloses they are under 18 will also have their account and IP address permanently banned — FunChat is strictly 18+ and is not designed, intended, or permitted for use by minors.

If you encounter any content that exploits or endangers a child, report it immediately at contact@funchat.in, use the in-app report button, or report directly to cybercrime.gov.in or your nearest police station — you do not need to wait for us to act.

Moderation and Bans

FunChat uses a combination of automated tools and human review to enforce these terms. Depending on the severity of the violation, enforcement follows approximate tiers such as:

• Abusive language, harassment, teasing or spam — temporary restriction or ban (5 minutes for a first offence, then typically 15 minutes, longer for repeats)
• Repeated link, phone-number or flooding violations in chat rooms — room ban of 30 minutes up to 24 hours
• Death threats, rape threats or serious threats of violence — extended ban (up to around 30 days), tied to your IP address and device
• Child sexual exploitation content (CSAM), or indicating you are under 18 — permanent ban of the account, device and IP address, and mandatory reporting to the authorities as described in the "Zero Tolerance for CSAM" section

These durations are indicative and may change without notice. We also reserve the right to remove any content that breaks these terms without notice, to ban any user at our discretion for behaviour we consider harmful, and to block access by IP address or device for repeated or severe violations.

Because FunChat is anonymous, bans are generally tied to your device identifiers and IP address. Attempting to get around a ban (new session, cleared cookies, VPN or proxy) is itself a violation and may lead to further or permanent action.

Automated decisions can be mistaken, and FunChat does not guarantee their accuracy. If you believe a ban was a mistake, write to support@funchat.in with your username and we will review it, but ban decisions remain at our discretion.

Reports in Friends. If you report someone in Friends, only the message you picked, the 5 messages before it and the 5 after it are sent to our AI review and kept for a moderator to check, not your whole chat. Scams, fraud and blackmail lead to a ban of 15 days, death or rape threats to a ban of 30 days, and child-safety content and real terrorism to a permanent ban of the account, device and IP address, and we may report it to the authorities. If you think a ban is a mistake, write to support@funchat.in and a person will read the reported message and the ones around it and decide.

Legal orders. We act on valid orders from courts and appropriate government authorities, and on valid complaints, within the time the IT Rules require. We may share user information and records with law enforcement where the law requires it.

Reporting, Copyright and Takedown Requests

You can report any user, message, image or username with the in-app report button, or write to support@funchat.in. We acknowledge complaints within 24 hours.

• Copyright and other rights. If you believe content on FunChat infringes your copyright, trademark or other right, email support@funchat.in with: your name and contact details; what the work is and proof that you own it or act for the owner; where on FunChat the content appeared (feature, username, time); a statement that you act in good faith and that the information is accurate. We act on complete notices promptly and may remove the content, restrict the user and tell them about the complaint.
• Intimate images shared without consent are acted on within 2 hours of a valid complaint, and court or government orders within the time the IT Rules set.
• Counter-notice and appeals. If your content or account was actioned by mistake, write to support@funchat.in with your username and explain why. A person reviews it, but the final decision stays with us.
• False or abusive reports (for example repeated reports against someone to get them banned) can lead to action against the reporter.

Repeat infringers and users who keep breaking these terms may be banned permanently.

VIP Membership and Payments

FunChat offers an optional paid VIP membership (not a donation). By buying it you agree to the following:

• What you get. VIP unlocks a VIP badge and member features that we describe at purchase, such as extra image and calling limits, no ads in chat, voice-message and match preferences. Features may change, and we may add or remove features over time.
• Plans and time. Plans last for the period shown at purchase (for example 15 days, 33 days, 1 month or 3 months) and are not recurring subscriptions. VIP starts when we approve your payment. Unless we say otherwise at purchase, a new plan starts from its approval date and remaining time on an earlier plan is not added to it. Your VIP end date is shown in Settings.
• How payments work. You pay through UPI (or other methods we show) in your own payment app, then submit your payment reference. We check each payment before activating VIP. Approval is usually within a few minutes, but in some cases it can take longer. We never see or store your card details, UPI PIN or bank login. Fees, taxes and bank charges are your responsibility.
• Email and reminders. If you give an email, we send a receipt, expiry reminders and account notices to it. Please give an address you can access.
• Refunds. VIP is a digital service that is activated straight away. Payments are final and non-refundable, except where the law requires a refund or where we made an error (such as a duplicate charge). We may refuse or reverse an activation if a payment cannot be verified.
• Ending or losing VIP. VIP is tied to your username and account. If you delete your account, or we ban you for breaking these terms, we may end your VIP without refund. When VIP ends, VIP features switch off.
• Authority to pay. By making a payment you confirm you are authorised to use that payment method. Fraudulent or disputed payments may lead to a ban.

Disclaimers and Limitation of Liability

FunChat is provided "as is" and "as available" without warranty of any kind. We do not guarantee that the platform will be available at all times, error-free, secure, or free from harmful content posted by other users.

Intermediary status. As explained above, FunChat is an intermediary under the IT Act, 2000. We observe due diligence under the Act and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended), including publishing these terms, acting on lawful takedown and reporting requests, and maintaining a Grievance Officer. Subject to those obligations, FunChat is not liable for third-party information, data or communication links made available or hosted by users, as provided in Section 79 of the Act.

To the maximum extent permitted by law, FunChat and its operators are not liable for:

• Any content posted, sent, drawn, said or received by users, including text, images, audio and video shared in chat, calls, rooms or games
• Any loss or damage from your use of, or inability to use, FunChat, including interruptions, delays, data loss or the end of a service or feature
• Any unauthorised access to your account or data beyond our reasonable control
• Any error, false positive or false negative in automated moderation, filters, image screening, age or behaviour classification, or AI features
• Any harm arising from interactions, arrangements or meetings with other users, whether online or offline
• Personal information, photos or images that you choose to share and that are saved, screenshotted, leaked, re-shared or misused by another user or third party
• Third-party ads, links or services
• Any indirect, incidental, special or consequential loss, or loss of profit

Where liability cannot be excluded by law, our total liability to you for any claim is limited to the amount you paid FunChat in the 12 months before the claim (or ₹1,000 if you paid nothing). Nothing in these terms limits any right you have under law that cannot be waived.

You use FunChat entirely at your own risk. You are solely responsible for your interactions with other users.

Indemnification. You agree to indemnify and hold harmless FunChat, its operators and affiliates from any claim, liability, loss, damage or expense (including reasonable legal fees) arising out of your use of the platform, your breach of these terms, your breach of any law or third-party right, or any content you post or transmit through FunChat.

Intellectual Property

All design, branding, code, and content created by FunChat — including the FunChat name, logo, interface and original text — is the property of FunChat and may not be copied, reproduced or used without permission.

User-generated content (messages, images shared in chat) remains the property of the user who created it. By posting content on FunChat you grant FunChat a limited, non-exclusive licence to display and transmit that content to other users as part of the normal operation of the platform.

Games — Entertainment Only

Draw & Guess, Ludo, Tic Tac Toe and any other game on FunChat are free, casual games played purely for fun and entertainment. They are not games of chance for money, and FunChat does not offer betting, wagering, gambling, lotteries, deposits, stakes, cash prizes or any way to win, withdraw or exchange real money or anything of monetary value. Points, scores and leaderboard positions have no cash value and cannot be bought, sold or redeemed. VIP membership is a paid feature of the chat service, is not a stake in any game, and does not affect the outcome of a game. FunChat is intended to be an online social game service and not an online money game under the Promotion and Regulation of Online Gaming Act, 2025 or other applicable law. Please report anyone who asks you for money, stakes or payment in connection with a game.

Background Radio

FunChat does not host, record or own any music. Background Radio simply plays public radio stations through their open, publicly available streaming links. No copyright content is stored or re-distributed by FunChat; all rights belong to the respective broadcasters. Stations may change or go offline at any time. Streams are provided by third parties and are subject to their own terms. FunChat is not responsible for the content, availability or quality of any station.

Governing Law, Disputes and Grievances

These Terms of Service are governed by the laws of India. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts of India at the place where FunChat is operated from. Before going to court, please try to resolve a dispute by writing to support@funchat.in.

If any provision of these terms is found to be unenforceable, the rest will continue in full force. Our failure to enforce a term is not a waiver of it. You may not transfer your rights under these terms. We may transfer ours as part of a sale or reorganisation of the service.
